The terms and conditions set forth therein (the "Terms of Use") constitute a legally binding agreement between Hardroad and you regarding the terms on which Hardroad offers you access to the Web Site. By accessing and using the Web Site, you agree to be bound by each of the Terms of Use and all applicable federal, state and local laws and regulations governing the Web Site. If you do not agree with each of the Terms of Use, you are not authorized to access or use the Web Site for any purpose.

We continuously study how Hardroad — the Web Site and the Hardroad application (together, the "Service") — is used in order to improve it. By using the Service you agree that we may: (a) collect and analyze all data generated by your use of the Service, including tasks, goals, habits, logs, time metrics, journal and media metadata, device and usage data; (b) conduct experiments in which features, content, prompts, notifications, or interface elements are varied among users, including on a randomized basis, to evaluate and improve the Service; (c) create and retain de-identified and aggregated data from your information, which is no longer personal to you, and use it for any lawful purpose, including publication of aggregate statistics; and (d) use your data to develop and improve our behavioral models and algorithms. We will never sell your personal information or use the contents of your private entries for advertising.

If we ever want to include your data in published scientific research, or enroll you in a formal study, we will ask you separately — participating in research is always your choice and never affects your access to Hardroad.

These Terms of Use constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties regarding such subject matter. No waiver by Hardroad of any breach of default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

This section details obligations under California Civil Code Sections 1798.80 to 1798.84 regarding breach notification for computerized data containing personal information.
